中企对美出口退税通道打开 涉千亿级税款怎么追回？美国律师给出建议（视频）

深圳新闻网2026年4月3日讯（记者 张玲 翁任莹）美国最高法院宣判，裁定特朗普大规模关税政策违法，这也为中企对美出口追回税款正式打开千亿级关税退税通道。近日，美国律师范德尔（Lyle Vander Schaff）以分享嘉宾的身份，在深圳参加华商举办的“美国关税之争与企业应对策略”专题研讨会。会前，他接受深圳新闻网记者的采访，就进口商如何退税给出建议。

范德尔（Lyle Vander Schaaf），美国克威莫宁律师事务所的合伙人，常驻美国华盛顿特区执业，是一名国际贸易和知识产权律师。此前，曾担任美国国际贸易委员会法律顾问办公室顾问。

深圳新闻网记者：能否介绍一下美国法院裁定特朗普关税政策违法后，目前关税退税的进展？

Lyle Vander Schaff律师：Since the US Supreme Court invalidated the IEEPA tariffs，a number of parties have filed suits in the courts.

And the court is awaiting a proposal from the US Customs and Border Protection for how they're going to conduct the refunds.   

自从美国最高法院宣布 IEEPA 相关关税无效后，已有多个原告向法院提起诉讼。目前，法院正等待美国海关与边境保护局提交关于如何开展退款的方案。

There are certain procedures that we think will be followed ，and we believe that the safest approach for parties is to file a court appeal so that they are part of this refund process.

But right now， we are still waiting for customs to provide a proposal to the court about how they intend to administer the refunds.

我们认为后续将遵循一定的程序，并且相信对相关方而言，最稳妥的方法是提起诉讼，以确保参与退款流程。但目前我们仍在等待海关向法院提交其退款管理方案。

记者：那么，您对进口商有什么建议呢？

Lyle Vander Schaff律师：The advice we're giving importers to seek a refund is to join the lawsuits at the US Court of International Trade,1st court that addressed these IEEPA tariffs.  They ruled them improper.

There was an appeal and then it went to the Supreme Court. And this court is now dealing with the refund issue.

我们给想要申请退款的进口商的建议是，参与美国国际贸易法院的相关诉讼，该法院是首个处理这些IEEPA关税案件的法院，当时判定这些关税不符合规定 。案件经历上诉后，最终提交至最高法院。如今，该法院正处理退款事宜。

And the safest course of action is to file a complaint with the court seeking a refund.We say this because it's not clear that US Customs or the US Department of justice who represents customs in the courts is going to allow any other type of process.

最稳妥的行动方案是向法院提交诉状以申请退款。我们给出这一建议的原因在于，目前尚不清楚美国海关或在法庭上代表海关的美国司法部是否会允许其他类型的流程。
